Elevaite Academy – Terms of Service

1. Introduction & Scope


Welcome to Elevaite Academy (the “Platform”), operated by Elevaite Ltd. (Company No. 15930449, registered in England and Wales,

registered office: C/O Digi Accountancy, Sun House, 2-4 Little Peter Street, Manchester, Greater Manchester, M15 4PS, United Kingdom) (“Elevaite”) (we”, “us”, or “our”).


These Terms of Service (the "Terms”) form a legally binding contract between Elevaite and you (the “User”) and govern your access to and use of:


www.elevaiteacademy.com and any sub-domains (the “Site”);all on-demand generative-AI training courses, digital content, certificates, communities, support channels, mobile or desktop apps, and related services we provide worldwide (collectively, the “Services”).


The Platform is offered globally but is governed exclusively by the laws of England and Wales.




2. Acceptance of Terms


Binding contract. Browsing, registering, purchasing, posting, or otherwise using any part of the Platform constitutes your acceptance of these Terms and the policies referenced herein.Updates. We may amend the Terms periodically. If changes are material, we will give at least 14 days’ notice via email or a prominent Site banner. Continued use after the effective date means you accept the revised Terms.Entire agreement. These Terms, together with our Privacy Policy, Cookie Policy, and any course-specific terms, constitute the whole agreement between you and Elevaite.




3. Eligibility


You must be 16 years of age or older (or the age of digital consent in your jurisdiction, whichever is higher).If you are under 18 you may use the Platform only with the consent of a parent or legal guardian, who remains responsible for your actions.You confirm that entering this contract does not breach any other agreement or law applicable to you.




4. User Accounts & Responsibilities


Registration. Certain features require an account. Provide accurate, current information during sign-up.Security. Keep your password confidential; you are liable for all activity under your credentials. Notify us promptly of unauthorised use.Single-user rule. One account per user; do not share, transfer, or sell access.Accuracy. Keep profile and billing details up to date.Verification. We may request identity or eligibility evidence and may suspend accounts that breach these Terms.




5. Intellectual Property


Elevaite Content. All courses, videos, texts, graphics, code, trademarks (including ELEVAITE and ELEVAITE ACADEMY), logos and other materials (“Elevaite Content”) are owned by Elevaite or its licensors and protected by UK and international IP laws.Licence to you. Subject to payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access Elevaite Content for personal, non-commercial learning via the Platform.Prohibitions. You must not copy, reproduce, resell, stream, embed, reverse-engineer, or exploit Elevaite Content except as expressly permitted.Feedback. Any ideas or suggestions you submit may be used by us without compensation.




6. Payments, Pricing & Refunds


Currency. Prices are displayed in Pounds Sterling (GBP) by default; currency selectors are estimates only. Your card issuer may apply conversion fees.Taxes. UK VAT is included where applicable. Non-UK users are responsible for local taxes or duties.Payment methods. We accept major debit/credit cards and other methods shown at checkout. By paying, you authorise us (or our processor) to charge your chosen method.Statutory cooling-off (UK/EU). You have a 14-day right to cancel digital-content contracts unless you request immediate access and acknowledge losing that right. Clicking “Start Course” counts as such acknowledgement.Elevaite Guarantee. We additionally offer a 7-day “no-quibble” refund on individual course purchases, provided you have watched no more than 20 % of the course. Refunds are processed to the original payment method within 14 days.Subscriptions. Subscriptions auto-renew until cancelled. Cancel anytime via Account → Billing; access continues until the end of the paid term.Chargebacks. Unauthorised chargebacks may result in immediate suspension. Please contact us first to resolve billing issues.




7. User-Generated Content (UGC)


Ownership. You retain ownership of content you post (“UGC”).Licence to Elevaite. By uploading UGC you grant Elevaite a worldwide, royalty-free, irrevocable, sublicensable licence to host, display, reproduce, distribute and adapt that UGC to operate, improve and market the Platform.Your warranties. You warrant that you own or have rights to post the UGC and that it does not infringe any third-party rights, violate law or breach these Terms.Moderation. We may, but need not, monitor, edit or remove UGC at our discretion.




8. Prohibited Conduct


You agree

Use the Platform for unlawful, deceptive or harmful purposes;Post viruses, malware or rights-infringing content;Harass, defame, or discriminate against others;Share login credentials or download courses for redistribution;Scrape, crawl, or commercially exploit the Site’s data;Attempt to breach or circumvent security measures;Misrepresent Elevaite affiliation or present our certificates as accredited qualifications;Circumvent geographic or access restrictions.




9. Digital-Learning-Specific Clauses


9.1 Content Delivery


Courses are delivered

online only

; no physical goods are shipped. You are responsible for a suitable device and stable internet connection.


9.2 Instructor & Learner Conduct


We foster respectful collaboration. Bullying, hate speech, or spam in forums may lead to suspension.


9.3 Certificates


Completion of required lessons and assessments grants a digital

Certificate of Completion

that:


Confirms course completion;Does not award academic credit or professional licensure;Can be displayed on your profile or downloaded as PDF.


9.4 Non-Accreditation Disclaimer


Elevaite courses are

not accredited

by any governmental, academic or professional body. They serve

informational and skill-development purposes only

.




10. Disclaimers


Educational use. Content is provided “as-is” for general learning; it is not legal, financial, medical or professional advice.AI outputs. Generative-AI tools may produce inaccurate or biased results; verify outputs before relying on them.No warranties. To the fullest extent allowed by law we disclaim all express or implied warranties regarding the Platform’s accuracy, availability, fitness or suitability.Interruptions. We do not guarantee uninterrupted service; outages or maintenance may occur.




11. Limitation of Liability


Cap. To the extent permitted by law, Elevaite’s total aggregate liability for direct damages arising from the Services shall not exceed (a) £100 or (b) the fees you paid us during the 12 months preceding the claim, whichever is greater. We are not liable for indirect, incidental or consequential loss.Statutory rights. Nothing limits your statutory rights or our liability for death, personal injury or fraud caused by our negligence.




12. Indemnity


You will indemnify and hold harmless Elevaite, its directors, employees and agents from all claims, damages and expenses (including reasonable legal fees) arising out of your misuse of the Platform, breach of these Terms, or infringement of any third-party right.




13. Termination & Suspension


By you. You may delete your account at any time via Account → Settings.By us. We may suspend or terminate your access immediately if you breach these Terms or if required by law.Effect. All licences granted to you end upon termination. Sections intended to survive (e.g., IP, Disclaimers, Liability) will continue to apply.




14. Governing Law & Dispute Resolution


Law. These Terms (and any non-contractual disputes) are governed by the laws of England and Wales.Jurisdiction. The courts of England and Wales have exclusive jurisdiction, save that EU consumers may bring proceedings in their home courts.Informal resolution. Please email [email protected] before commencing formal action; we aim to resolve issues amicably.ADR. EU consumers may use the ODR platform: https://ec.europa.eu/consumers/odr.




15. Other Important Terms


Severability. If any provision is unlawful, the remaining clauses remain in effect.Assignment. We may assign our rights and obligations; you may not without prior written consent.No waiver. Failure to enforce a right is not a waiver of future enforcement.Force majeure. We are not liable for events beyond reasonable control (e.g., natural disasters, governmental acts, internet outages).

17. Service Changes


We may modify, suspend or discontinue any feature or content at any time. Where changes materially reduce paid functionality, we will give

and may offer a pro-rated refund.
